CSS is a registered NDIS allied health provider based in Coomera, Queensland. Our medicolegal OT service is independent of our NDIS treating work. Reports are prepared by experienced occupational therapists trained in medicolegal assessment and evidence-based reporting.

A New Chapter for CSS

Capability Support Services has been delivering allied health and NDIS support across the Gold Coast and Brisbane for several years. We are known for our mobile, person-centred model and our multidisciplinary team of occupational therapists, speech pathologists, behaviour support practitioners, and psychologists.

Today we are excited to announce something new. We are now offering independent medicolegal occupational therapy assessments, expanding our reach beyond the NDIS to serve solicitors, insurers, rehabilitation providers, and case managers across South East Queensland and beyond.

This page explains what medicolegal OT is, what our service covers, who it is suited to, and exactly how to make a referral.

In a nutshell: medicolegal OT provides an independent, evidence-based picture of how an injury or condition affects someone's daily life and work. That picture is then used to support fair outcomes in legal, insurance, and compensation proceedings.

What Is a MedicoLegal Occupational Therapy Assessment?

A medicolegal occupational therapy assessment is an independent evaluation conducted by a qualified occupational therapist for use in legal, insurance, or compensation proceedings. The key word is independent. The assessor has no prior treating relationship with the person being assessed, and no stake in the outcome of the claim. Their role is to give an honest, objective, evidence-based account of what they observe.

Medical records can tell a court or insurer what diagnosis a person has. What they often cannot tell is what that diagnosis actually means for the person on a Tuesday morning. Can they dress themselves? Can they drive? Can they get to a supermarket, prepare a meal, manage stairs, sit at a desk for an hour? A medicolegal OT fills that gap by observing and assessing function in the real world, then documenting it in a report that can withstand legal scrutiny.

Important distinction: a medicolegal OT does not provide treatment. They do not advocate for any party. They assess, observe, and report objectively. That independence is precisely what gives the report its value in a legal context.

Please note: medicolegal assessments at CSS are conducted on referral from legal, insurance, and rehabilitation professionals. We are not able to accept self-referrals for medicolegal assessments. How the Process Works

Referral Received

Submit your referral via our medicolegal referral page at capabilityss.com.au/medicolegal or call 1800 299 399. Include the brief, instructing party, relevant claim type, and any specific questions you need the OT to address.

Scoping and Fee Confirmation

Our team reviews the brief and confirms the scope of the assessment and fee schedule in writing before any work commences. No surprises.

Assessment Scheduled

The assessment is booked at a mutually convenient time. Our OTs travel to the person's home or another agreed location across the Gold Coast and Brisbane. File review components can be completed remotely.

Assessment Conducted

The OT conducts the assessment independently and objectively. The person being assessed is treated with respect and dignity throughout. No clinical records are shared with the assessor beyond what is specified in the brief.

Report Delivered

A written report is delivered to the instructing party within the agreed timeframe, typically four to six weeks from assessment date depending on complexity. Reports are clear, structured, and prepared to withstand cross-examination.

Expert Witness Availability

Our medicolegal OTs are available to provide expert evidence in court and tribunal proceedings, and to respond to written questions from either party within agreed timeframes.

A treating occupational therapist works directly with a client over time with the goal of improving their function and quality of life. A medicolegal occupational therapist conducts a single independent assessment with no prior or ongoing treating relationship. Their role is to provide an objective, evidence-based opinion for legal or insurance purposes, not to provide therapy or advocate for any party.

A CSS medicolegal OT report typically includes a review of relevant medical and clinical records, a structured functional assessment, Activities of Daily Living (ADL) analysis, assessment of work capacity where relevant, identification of care and support needs (past, present, and future), equipment and home modification recommendations with costings, and an expert opinion on the functional impact of the injury or condition. Reports are prepared to withstand legal scrutiny.

File review, opinion reports, and some assessment components can be completed via telehealth Australia-wide. In-person assessments are conducted across the Gold Coast and Brisbane by our mobile OT team, who come to the person's home or another agreed location.
